Senate Judiciary Committee Chairman Chuck Grassley has released updated legislative text for the Judiciary Committee's provisions in the Senate Republicans' One Big Beautiful Bill Act. The release follows approval by the Senate Parliamentarian.
Grassley commented, "Democrats are fighting tooth and nail to keep criminal illegal immigrants in our country and on the taxpayers’ dime. The voters rejected that radical approach in November, and Republicans are now disposing of Democrats’ radical open borders agenda by securing historic investments in border security, providing monumental support for law enforcement, and incorporating commonsense immigration and work authorization fees."
The parliamentarian ruled favorably on most of the Republican Judiciary provisions. Key measures include preventing Department of Justice (DOJ) funds from being used in sanctuary cities that do not enforce federal immigration laws (Section 100054(5)(C)), cutting off DOJ funds from certain non-governmental organizations (Section 100054(5)(B)), and several actions against federal courts' use of universal injunctions. These actions involve funding additional federal attorneys to challenge such injunctions (Section 100054(4)), requiring courts to publish metrics on these injunctions (Section 100101), and establishing judicial training programs about universal injunctions (Section 100102).
Additional provisions address creating a compensation fund for states handling costs related to incarcerating criminal aliens (Section 100054(7)) and enhancing screening processes for aliens entering or intending to remain in the U.S. (Section 100051(4)). Another measure aims to protect alien children from exploitation by collecting DNA from migrants without valid visas under Section 100051(5). Lastly, funds will be allocated to support state and local participation in homeland security efforts through the Department of Homeland Security, including immigration enforcement activities as outlined in Section 100051(7).
